I agree with Robin. Having done several books, chasing down the true owner on material is often very difficult. More than once, several competing foundations or trusts claim the only ones authorized to license to use.
Publisher contracts expect you to have proof of license or that they are yours personally. Their contract fine print passes any litigation issues to you as well.
